This terms of use (together with the documents referred to in it) tells you the terms of use on which you may make use of our website www.opentennis.net (our site), whether as a guest or a registered user. Use of our site includes accessing, browsing, or registering to use our site.

www.opentennis.net provides a service that allows account holders to create unique personal profiles and communicate with other members based on location in order to organise games of tennis.

Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site.

By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms of use, you must not use our site.

These terms of use refer to the following additional terms, which also apply to your use of our site:

Please check this page from time to time to take notice of any changes we made, as they are binding on you. It's important that you review these terms whenever we modify them because if you continue to use our site after we have posted modified terms on our site, you are agreeing to be bound by the modified terms. If you don't agree to be bound by the modified terms, then you can't use our site anymore. If you object to any change or modification, your sole recourse shall be to cease using our site. YOU AGREE THAT WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY CHANGE OR MODIFICATION TO THESE TERMS.

Your account and password

To access and use our site and services, you will need to register and create an account (your account). You can do this by providing an email address and password or through your account with Facebook. When creating an account, you will be required to provide certain personal information about yourself, including your email, gender, name and age. If you choose to register your account using your Facebook account, we will extract certain personal information from your Facebook account, such as your name, age, gender, email address and other personal information that your privacy settings on your Facebook account permit us to access.

It's important that you provide us with accurate, complete and up-to-date information for your account, and you agree to update such information, as needed, to keep it accurate, complete and up-to-date. Your profile may be deleted, and your account may be terminated without warning if we believe that you are under 18 years of age.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. You agree that you won't disclose your account password to anyone and you'll notify us immediately of any unauthorized use of your account. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE POUND STERLING (£1.00 GBP).

Content and content rights

For purposes of these terms: "content" means text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through our site; and "user content" means any content that account holders (including you) provide to be made available through our site. Accordingly, content includes but is not limited to user content.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy (see below).

The views expressed by other users on our site do not represent our views or values.

• Promote any illegal activity.
• Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
• Be likely to harass, upset, embarrass, alarm or annoy any other person.
• Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
• Give the impression that they emanate from us, if this is not the case.
• Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of our content standards through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with our content standards constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

• Immediate, temporary or permanent withdrawal of your right to use our site.
• Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
• Issue of a warning to you.
• Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

• Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of our content standards. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Rights you licence

By making any user content available on our site you hereby grant to GITOLOGY LTD a perpetual, non-exclusive, transferable, sublicenseable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform and distribute your user content in connection with operating and providing the services and content to you and to other account holders.

You are solely responsible for all your user content. You represent and warrant that you own all your user content or you have all rights that are necessary to grant us the license rights in your user content under these terms. You also represent and warrant that neither your user content, nor your use and provision of your user content to be made available through our site will infringe, misappropriate or violate a third party's intellectual property rights, rights of publicity or privacy, or any other rights or result in the violation of any applicable law or regulation.

You can remove your user content by specifically deleting it from your profile. However, in certain instances, some of your user content (such as chat messages you send) may not be completely removed and copies of your user content may continue to exist on our site. We are not responsible or liable for the removal or deletion of (or the failure to remove or delete) any of your user content.

Viruses

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
